This is the agreement between you and Fincharter. It sets out what you get, what you pay, what you can expect from us and what we expect from you. We wrote it to be read, not to be skipped.
Fincharter AS, Norwegian company registration number 837 716 772, Waldemar Thranes gate 5, 0171 Oslo, Norway, provides the service. We call ourselves «Fincharter», «we» and «us», and you «you».
The agreement applies from the moment you create an account, and for as long as you have one. By using the service, you accept these terms.
You must be 18 to hold an account.
Fincharter is an analysis and monitoring tool. We gather market data, calculate on it, explain what the figures mean, and tell you when something happens to companies you follow.
Fincharter is not an investment firm and holds no licence from the Norwegian Financial Supervisory Authority. We do not provide personal investment advice, we execute no trades, we hold no money or securities for you, and we transmit no orders. You trade yourself, through your own broker.
Everything you find here is general information. It is not tailored to your finances, your capacity for risk or your goals, and it is not an invitation to buy or sell anything.
Past performance is no guarantee of future returns. Investing carries risk, and you can lose the entire amount you invest. The decisions are yours, and so is the responsibility.
Some of what we show is our own calculation, and some is other people's figures. You should always be able to tell which is which, and what sits behind it. We follow the requirements of Article 3 of Regulation (EU) 2016/958, which applies to everyone who publishes estimates of the value of a financial instrument.
We go beyond the requirement and publish the methodology too, as the heavier Article 4 asks of investment firms. Not because we must, but because a calculation you can check is worth more than a number you have to believe.
We make money from subscriptions, and from nothing else. That is the whole business model, and it is deliberate: the person paying us should be you.
We are not paid by brokers. «Trade with your broker» is an ordinary link to the broker's own page, with no tracking and no commission to us. You can check that yourself by looking at the address.
We are not paid by companies to be mentioned, rated or included in a list. Nobody can buy their way into a Health check or an agent match.
We do not make markets, we do not receive payment for order flow, and we have no arrangements with issuers.
If any of this changes, it will be stated here before it takes effect.
Analyse is a language model. You are talking to a machine, not to a person, and we say so both here and in the service.
A language model can be wrong, including when it sounds certain. It can misread a figure, confuse two companies, or answer confidently about something it does not know. On the Analyse screen the sources it actually drew on are listed beneath the answer, labelled «Basert på». Use them, and check any figure that matters against the company's own reporting before you act on it.
The answers are information, not advice, in the same way as the rest of the service. See section 2.
The account is personal. You may not share your login, and you are responsible for what happens on your account.
The information you provide must be accurate. If you discover that someone else has used your account, tell us immediately.
You can delete your account whenever you like, from Settings. What happens to your data then is set out in the privacy policy.
Fincharter has a free plan and two paid tiers, Pro and Max. What each tier includes is set out on the pricing page, and the price shown there is the one that applies, including VAT.
All paid subscriptions start with seven days free. You must register a payment method to start the trial. If you do not cancel before it ends, the subscription continues at the ordinary price.
The subscription renews automatically, monthly or annually, until you cancel. Payment is by card through Stripe or by Vipps. We never see your card number.
If we change the price, we notify you at least 30 days before it applies to you, and you may cancel before it takes effect. The price in a period you have already paid for never changes.
If you use a campaign code, the terms stated where you redeemed it apply.
You have a 14-day right of withdrawal under the Norwegian Right of Withdrawal Act when you buy a subscription online as a consumer. The period runs from the day after the agreement was concluded.
The service is delivered immediately, and you get access before the 14 days are up. Under section 22(n) of that Act, the right of withdrawal lapses once delivery of digital content has begun, but only if you expressly consented to it and acknowledged that the right is thereby lost. If you have not done both, the right of withdrawal stands for 14 days.
To use the right of withdrawal, keep it simple: write to hei@fincharter.no, or use the standard withdrawal form from the Norwegian Consumer Authority. We need no reason, and we refund within 14 days of receiving your notice.
Regardless of the right of withdrawal, you can cancel at any time and stop paying from the next period. See section 9.
You can cancel whenever you like, with no lock-in and no reason given. With card you do it under Subscription in the app, and with Vipps in the same place.
If you cancel, you keep access for the period you have paid for. We do not refund a period already begun, unless the right of withdrawal applies or we are in breach of the agreement.
We may terminate the agreement with you if you materially breach these terms, or use the service for something unlawful. We give notice first and an opportunity to put it right, unless the breach is too serious to be put right.
Prices, financial statement figures, estimates and company information come from external suppliers, mainly EODHD and Finnhub, and from companies' own reporting and exchange announcements. News comes from published sources, which are stated on each item.
The data is not real time. It is updated periodically, and a price you see may be delayed. Do not use Fincharter as the basis for trading that requires real-time data.
We do not control the sources and cannot guarantee that everything is correct or complete. If you find an error, tell us: we fix what we can, and pass on what belongs with the supplier.
The data is licensed for use within Fincharter. You may use it for your own investment decisions, but not extract it systematically, resell it, or build a competing service on it.
Fincharter owns the service, the models, the Health check, the text and the design. You receive a right of use for as long as you have an active subscription, for your own use.
You own what you put in yourself: your portfolio, your notes, your agents and your posts. We use it to deliver the service to you, and for nothing else. We do not use it to train models.
If you post in the forum, you grant us the right to display it within the service. You can delete your posts whenever you like.
We do our best to keep the service running, but we do not promise it is never down. Maintenance, failures at our suppliers and matters outside our control can cause interruptions.
We develop the service continuously. Features are added, changed and removed. If we remove something material that you pay for, we say so in advance, and you may cancel without paying for the remainder of the period.
Fincharter is not liable for investment decisions you make, or for losses arising from them. That applies also where the decision rests on something you saw here. See section 2: we do not advise, and we do not take positions on your behalf.
Otherwise our liability towards you is limited to what you have paid us over the last twelve months. We are not liable for indirect loss, lost profit or consequential damage.
The limitations above do not apply where we have acted intentionally or with gross negligence, and they do not apply where mandatory consumer legislation says otherwise. If you are a consumer, you have rights under Norwegian law that no agreement can take from you, and these terms shall never be read as doing so.
We may change these terms. If a change is to your detriment, we notify you by email or in the app at least 30 days before it applies, and you may cancel before it takes effect.
Minor changes, such as a corrected typo or a clarification that does not change the substance, we make without notice. The date at the top says when we last touched the text.
Norwegian law governs the agreement.
If you disagree with something, we would rather hear it first, at hei@fincharter.no. Most matters are settled there.
If we do not get there, you as a consumer may bring the matter to the Norwegian Consumer Authority or the Norwegian Consumer Council. If you live in another EEA country, you may use the European Commission's online dispute resolution platform.
The venue is Oslo District Court. As a consumer you may in any case choose to bring proceedings where you live, and you never lose that right by accepting these terms.
Where these terms exist in more than one language, the Norwegian text prevails if the versions disagree.
